Residence Permit in Ukraine 2026: New Rules and Exchange Deadlines
The Cabinet of Ministers of Ukraine has adopted the Resolution dated February 5, 2026, No. 141 βOn Amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 1202 of October 21, 2022β.
The Resolution comes in force 3 months from the date of its official publication.
What has changed?
In 2022 the Cabinet of Ministers Resolution of October 12, β1202 allowed temporary and permanent residence permits, that expired after February 24, 2022, to remain valid and gave foreigners the right to enter and legally stay in Ukraine for the entire period of martial law.
On 5 February 2026 the above allowances effectively lost force and now any stay with an expired residence permit is considered illegal.
What needs to be done?
Foreigners, the holders of expired residence permits, must apply for an exchange through the State Migration Service of Ukraine in person. Submitting documents remotely or through a Consulate of Ukraine is not possible.
The deadline for application: a 90-day grace period for exchange begins from the date the new rules take effect, the final deadline is August 5, 2026.
What happens if the deadline is not met?
Serious consequences may arise:

enforcement measures, including deportation.

ban on re-entry

refusal to process other documents

obtaining a new residence permit (if eligible) from scratch (incl. leaving the country to obtain a D-type visa).
