Kazakhstan Work Permit Overhaul

We would like to inform you about the amendments and additions to the rules of obtaining work permits in Kazakhstan, including within the procedure of intra-corporate transfer (ICT), which will enter into force on September 1, 2025.

Which legislation introduces the changes?

Acting Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan No.93 dated March 28, 2025.

What are the changes?

  1. Applications other than the e-government web portal www.egov.kz and www.elicense.kz is also implemented through the portal migration.enbek.kz – subsystem of the Electronic Labor Exchange (enbek.kz), which ensures the registration and movement of migrants, as well as monitoring the provision of services in the field of migration.
  2. A new clause has been introduced on the search for the appropriate candidates on the domestic labor market by the employer, by sending information about the availability of vacancies to the electronic labor exchange (www.enbek.kz). After 15 calendar days from the date of submitting information on the availability of vacancies to the electronic labor exchange, the employer sends an application for the work permit to attract foreign labor, indicating the publication code of the posted information about vacancies.

  3. Consideration by the Commission for making a decision on the issuance of work permits for the recruitment of foreign labor is excluded. Now the functions performed by the members of the commission will be implemented by integrating information systems that provide data on the violation of Article 519 of the Administrative Code by the employer. Namely, they will check for information about violations registered in the information systems "Unified Register of Administrative Proceedings", "Migration Police", IS "OHS", as well as information in AIS "FLF", AIS "UASEC".

  4. From the moment of registration of the application, documents are reviewed for compliance with the list of requirements for the provision of public services. In order to establish the authenticity of the legalization stamp or apostille on educational documents, the local executive body sends relevant requests to the Ministry of Foreign Affairs of the Republic of Kazakhstan, unless otherwise provided for by an international treaty or the legislation of the Republic of Kazakhstan.

  5. Paragraphs 27 and 32 were excluded from the rules, which established cases when a permit to attract foreign labor is not issued or extended.

  6. The condition for issuing permits has been changed, which does not apply to small businesses with no more than 20 employees (the number was not previously indicated).

  7. Foreigners involved in the 4th category will be replaced by Kazakhstani citizens in identical positions or other positions belonging to the fourth category for a period of six months to one year, and they must also provide information on the replacement in the portal migration.enbek.kz (previously, it was only for identical positions).
